Terms of sale

1 - General Provisions

When a user fills out the order form on this website and confirms the order (by clicking on the "order confirmation" button) he fully accepts these terms and conditions, which will be only applicable to the following contract.

Patrice Chapon reserves the right to refuse an order in case the customer fails in one of his/her obligations and, more generally, to refuse any order presenting an abnormal nature for any reason whatsoever. The order is finalized only after confirmation by Patrice Chapon.

Patrice Chapon confirms his acceptance of the order by e-mail sent to the user or, where applicable, the refusal thereof within 48 business hours of the order being entered on the Internet by the customer.

The company, "Chocolat Chapon", undertakes, in case of acceptance of an order to sell and ship with a high quality carrier and in the best conditions the products ordered by the customer at the price on the invoice generated by the order.

2 - Customer Obligations

The customer agrees to complete the order form accurately, giving his address and the delivery address during business hours + a telephone contact. Otherwise, the command will not be accepted.

The customer agrees not to resell the products; the order must be for personal use or for the personal use of the person to whom the consignment is destined.

Our clients are committed to abiding by the product storage conditions, and the use before date indicated on the packaging.

3 - Price

Product prices are net and inclusive of tax. Delivery is subject to a fee. Prices are guaranteed within the limits of available stocks and subject to change in the VAT rate. Quantity discounts will not be granted. Prices are in Euros.

4 - Payment

Payment of products is made only by credit card: VISA, MASTERCARD, online from the web, through the secure payment system of BNP Paribas. Validation of the credit card payment is immediate.

No shipments will be made without confirmation of payment.

5 - Delivery Rates

Each product has a corresponding net weight and gross weight. Delivery rates are set based on package weight and destination zone.

6 - Transport - Shipping Times

Deliveries of orders are made by Colissimo in metropolitan France as well as deliveries outside of France and to French overseas territories.

Orders received over the Internet after acceptance of payment by the bank card centre, are prepared and shipped in 48 hours. Delivery times are as follows:

Metropolitan France: Approximately 72 hours maximum excluding weekends with standard Colissimo

EEC countries: 3 to 4 days

Countries outside Europe, North America, Central America, Middle East, Asia, France overseas about 5 days. For some destinations in Asia and South America, delivery times are sometimes longer.

Because of blocking orders by the Mexican customs, we will not provide shipments to Mexico.

Orders placed on the website from Friday afternoon (France) until Monday morning, leave for delivery as of Tuesday afternoon.

These times are indicative. No compensation can be claimed in the event of any delay in delivery.

We are in no way liable for damage that may occur to products if the package has been opened during transport or in case of absence of the customer or recipient at the time of delivery.

We warn our customers that for faraway destinations (between 3 and 5 days’ delivery) despite special packaging used during the warm seasons handmade chocolates will travel best during the cold seasons of the year.

7 - Replacement and refunding

No return nor refund or replacement will be accepted. No reservations may be made by the customer concerning the criteria for the taste, freshness and appearance of the products.

In cases where deliveries can not be made because of customs-related problems, strikes or damage or any other force majeure under the responsibility of the carrier, the products will be replaced or refunded.

8 - Procurement

Chapon products are made in the traditional way and are available in limited quantities. It is specified that orders placed between 15/12 and 31/01 are at greater risk of not being confirmed as those performed during normal periods of the year.
9 - Complaints

The customer must ensure that the delivery is in compliance with the order.

Any complaint must, to be taken into account, intervene within 48 hours of receipt. Goods travel at the risk of the recipient, their property being transferred upon acceptance of the order.

10 - Disability - Force majeure - Right

If any of these terms and conditions should be declared inapplicable or invalid for any reason, such invalidity shall not affect the application or validity of the other provisions of the general conditions; the condition invalidated or considered inapplicable will be replaced by the provision which is as close as possible to it. Neither the Company "Chocolat Chapon" nor the client can be held liable for any failure, possibly caused by a case of force majeure beyond its control, including, without them being limited cases: war, riots, insurrections, interruption of transport, import or export problems, strikes, lock-outs, shortages, fire, earthquakes, storms, or flooding.

These general conditions are governed exclusively by French law. The Commercial Court of Paris shall have sole jurisdiction over any disputes about them.
